Davontea Jerome Mallett

Bartow County deputies were dispatched to Walmart on Market Place Boulevard in Cartersville on Thursday afternoon in reference to a fight.

Davontea Mallett of Cartersville said while he was walking in the parking lot, he noticed a red Dodge pickup truck driving towards his wife who was riding a Walmart scooter. He said he jumped in front of the truck yelling stop. Mallett stated that there was an exchange of words between him and the driver and he hit and grabbed him.

Mallett’s wife said she was riding the scooter in the parking lot, saw the truck going towards her, and didn’t think the truck was going to stop. She said her husband jumped in front to make it stop. She stated she didn’t see the fight start, but knew there was a physical altercation.

One witness saw Mallett yelling at the guy in the truck. She said the man in the truck opened his door to hear what was being said and Mallet said don’t get your rear beat. She said when the man went to close his door, Mallet grabbed him out of the vehicle and started to punch and kick him.

Another witness said he saw Mallett pull the driver out, knock him to the ground, kick him twice, and punch him multiple times in the back of the head. That witness stated that the truck was at least 15 feet away from the scooter and going slow.

The driver himself said Mallet jumped in front of his truck yelling and saying he was going to beat his rear. He said Mallet hit him in the face and didn’t remember anything else until he was trying to get up.

Deputies observed and photographed a cut above the driver’s left eye and his immobilized right wrist. The driver received medical treatment from EMS, but said he was going to drive himself to Cartersville Medical Center. It was later confirmed that his wrist was broken.

Davontea Mallett was arrested and charged with battery against a person who is 65 years of age or older, aggravated battery, and exploitation and intimidation of an elder person.
