ATLANTA – Georgia Secretary of State Brian Kemp and State Labor Commissioner Mark Butler alert Georgia businesses to ignore threatening mail from an unregistered entity which calls itself “Labor Poster Services.” This entity mails official-looking but deceptive notices to companies about labor law compliance and attempts to bill for unnecessary document fees.

“This entity is soliciting businesses by scaring people into buying overpriced labor law posters,” stated Secretary Kemp. “Do not fall for this gimmick simply because it looks like a government-issued notice. Although it looks official, it is nothing more than a mass mailer, and you are not required to purchase products from this company.”

The notice cites federal law and threatens thousands of dollars in fines for poster non-compliance. Technically, it is not illegal for companies to solicit business in this manner, but business owners should research which types of labor law posters are required in the workplace since federal and state requirements depend on the nature and size of the business.

“Solicitations like this one surface from time to time,” said State Labor Commissioner Mark Butler. “We keep a permanent alert about them on our web site, as well as instructions about which workplace posters are required and where employers can obtain them for free.”

The Georgia Department of Labor is responsible for providing three workplace posters: Employer Vacation (DOL-154), Equal Pay for Equal Work (DOL-4107) and Unemployment Insurance Protections for Employees (DOL-810). Copies may be downloaded from dol.georgia.gov/gdol-required-workplace-posters. Individuals can also obtain copies by calling (404) 232-3396 or emailing Phyllis.Clayton@gdol.ga.gov. This site also lists posters required by other agencies and the applicable contact information.

If your business receives scam mail or other suspicious solicitations, please contact the Secretary of State’s Corporations Division at (404) 656-2817 or the Department of Law’s Office of Consumer Protection at (404) 651-8600. Employers with questions about workplace posters or other services of the Georgia Department of Labor may call toll-free at (855) 436-7365.
